August 26, 2020 – Sloane and Walsh, LLP (, a leading national law firm with a focus on litigation and insurance law, is pleased to announce that partners John Donovan and Tierney Chadwick successfully defended an insurance company with respect to Chapter 93A and Chapter 176D claims for alleged unfair claims settlement practices. The plaintiff, a commercial property owner, also filed suit against her insurance broker for negligence.

The plaintiff alleged that a tenant had intentionally caused property damage to her commercial property while the tenant was vacating the premises. The plaintiff also alleged that her property insurer had failed to promptly investigate her claim.

The Massachusetts Superior Court allowed the insurer’s Motion for Summary Judgment with respect to the bad faith claims because the insured failed to notify the insurer of the loss within the two years limitations period set forth in the policy and the applicable statute. The Court also held that the entrustment exclusion in the policy precluded coverage for the loss.
